5. Official residence means any house rent by entities entitled to live in official residences as prescribed in this Law over the duration by which they are on duty. 8. Housing construction challenge means all deliberate items of labor which can be designed to use capital to construct new housing, or technical and/or social infrastructural works for residential use, or to renovate or restore housing in a sure location. 3. Apartment constructing means any multi-storey building which has a number of apartments, public stairs, corridor methods, private areas, frequent areas and customary infrastructural works for organizations, households or individuals, together with residence buildings for residential use and combined-use buildings for both business and residential purposes. 11. Using the apartments not for residential purposes; using the area for business functions within the house building under authorized project for buying and selling flammable materials, explosives, providing companies inflicting environmental pollution, noise or unfavorable effects on the lives of households and people within the house constructing as prescribed in rules of the government. In case of important necessity for national defense and security purposes; socio-economic improvement for nationwide or public benefits, or state of warfare, state of emergency, or disaster response, the State shall resolve the purchase, commandeering, or demolition of housing under lawful possession of the organizations, households, or individuals, then the State must pay compensation and carry out policies on relocation to homeowners as prescribed.
17. Lease purchase agreement means an agreement, whereby the lessee pays an option fee of 20% of a house, except the lessee is ready to pay an option charge more than 20% but not exceeding 50% of the home; the remaining fee shall be considered because the monthly rent over a certain duration; the lessee shall acquire the ownership of such home if he/she pays off the total quantity when the lease purchase agreement expires. 2. If for an individual has a fixed-term homeownership as prescribed in Clause 1 Article 123 in this Law, he/she might train the rights prescribed in Clause 1 of this article over the homeownership period, until in any other case agreed among the parties; when the contractual time period expires, the home which is underneath administration of the homeowner should be returned to the preliminary homeowner. 3. If the homeowner is a foreign group or individual, he/she shall have the rights prescribed in Article 161 of this Law. This has been created with the help of Công ty xây dựng.
10. Renovating, expanding, demolishing the homes underneath agreements on housing lease, lease buy, lending, permission for keep, or authorization of housing administration without the consent of the homeowner. This Law applies to organizations, households or people associated to possession, growth, administration, use, and transactions in housing and state management of housing in Vietnam. Use the home for residential functions and different functions not prohibited by laws of regulation. This Law stipulates ownership, development, administration, and use of housing; housing-related transactions; state administration of housing in Vietnam. Any household or individual is entitled to have residence by funding in housing construction, purchase, lease, lease purchase, receipt of reward, receipt of inheritance, receipt of capital contribution, trade, borrowing, keep, or authorization for housing management and different transactions prescribed in rules of regulation. 2. 12. Homeowner means any organization, household, or particular person having reliable housing via funding in housing development, purchase, lease purchase, receipt of reward, receipt of inheritance, receipt of capital contribution, or trade and different transactions prescribed in this Law and corresponding laws of law. 2.
